Heron Pond Condominium

The Heron Pond Condominium is located at 8400 S.W. 1st Street, Pembroke Pines, Florida. The community consists of 304 units spread over 19 buildings on approximately 25 acres. The property was initially developed as a garden apartment complex known as Runaway Bay in 1988 by Oxford Development. The project was converted to a condominium in late 2006. 

The City of Pembroke Pines is concerned that the general safety requirements —as outlined in the Florida Fire Prevention Code and the Florida Building Code— are not being maintained in the community. The City has requested that the Heron Pond Condominium's ownership and management submit the technical structural reports and make the necessary repairs required to address the significant structural issues within the Heron Pond community. The City's primary focus is the health, safety, and well-being of all of the residents of Heron Pond. On July 22, 2024, the City of Pembroke Pines received a letter from ACG Engineering Services Inc., the Engineer of Record for the Condominium Association, reversing the previously issued safety assessment. This determination now deems all units unsafe for occupancy. As of August 29, 2024, following the unsafe structure notice issued on July 24, 2024, all units have been vacated.

On April 26, 2024,  Broward County Chief Judge Jack Tutor appointed Mr. Daniel J. Stermer as Receiver for the Heron Pond Condominium Association

As of the Effective Date, pursuant to the Uniform Commercial Real Estate Receivership Act, §§ 714.01, et seq., Florida Statues, and the inherent authority of the Court, Daniel J. Stermer is hereby appointed by the Court as the court-appointed receiver authorized to take immediate possession and control of HERON POND CONDOMINIUM ASSOCIATION, INC. including all of the Receivership Entity’s “Assets” and “Property,” whether held directly, beneficially or indirectly by any person or entity. 

From and after the Effective Date, and through the Receivership Termination Date, the Receiver shall have all the powers of the Association’s Board of Directors and is authorized to, and shall act as the Association’s Board of Directors notwithstanding the unexpired term of any or all of the Directors or the Receiver not having been previously appointed to the Association’s Board of Directors. Any action taken by the Board from and after the Effective Date, and through the Receivership Termination Date, shall be null and void unless expressly adopted in writing by the Receiver in his sole and absolute discretion. During the period from and after the Effective Date, and through the Receivership Termination Date, the Receiver shall have the sole authority to confer with and resolve any issues, if at all, involving the City of Pembroke Pines, including but not limited to any Unsafe Structure Notice(s) issued by the City of Pembroke Pines.

As of July 24, 2024, all units within the Heron Pond Community have been issued an unsafe structure notice. All units must be vacated by August 29, 2024.

The City of Pembroke Pines issued Unsafe Structure notices on August 14, 16, and September 02, 2023, for Buildings 2, 3, 5, 10, 14, and 16, instructing occupants to evacuate the structures. Individual units (Units #106, 107, 206, and 207) in Building 9 were deemed unsafe as of October 12, 2023. Subsequently, all remaining units in Building 9 have been deemed unsafe as of July 3, 2024. Unsafe Structure notices were also issued on October 12, 2023, to Building 11 (Units # 102, 104, 107, 202, 204, and 207), and Building 12 (Units # 101 & 201). Additionally, on October 25, 2023, individual units in Building 4 (Units # 104, 105, 108, 204, 205, and 208), Building 13 (Units # 107, and 207), and Building 18 (Units # 102 & 202) were issued unsafe structure notices.  On October 31, 2023, Building 17 (Units # 101, 108, 201, and 208) was issued an unsafe structure notice.

Additional notices may be issued should the ownership and management not perform the necessary repairs.
